General Conditions of Sale of MIJE Paris Youth Hostels for groups

MIJE – Maisons Internationales de La Jeunesse et des Etudiants is a recognised public-interest association founded in 1958, authorised under Youth & Popular Education with the No. 75 JEP 04-193, whose registered office is located at 13 boulevard Beaumarchais – 75004 PARIS – France, and listed in the registry of travel agents and other tour operators under the No. IM 075 10 0395.

Financial Guarantor: UNAT-FMS 8 rue César Franck – 75015 PARIS. Insurer: RC HISCOX – Contract No. HA RCP0323871 (5 000 000 €).

Preamble

These General Terms and Conditions (« GTC ») apply to Bookings made for MIJE hostels on behalf of legal entities.

The services proposed by MIJE are reserved for the association’s members.

Any Booking made through MIJE supposes express acceptation without reserves of these GTC by the person having made the Booking (hereafter “the Client”).

These GTC are applicable to all quotes signed by the Client over the calendar year.

Article 1. Booking

The Client addresses a Booking request to MIJE. MIJE in return addresses a quote to the Client detailing the requested services and pricing conditions, accompanied by the GTC (unless they have already been signed by the Client during the civil year) and cancellation insurance.

The Client must pay a deposit, the amount of which will depend on when the contract was signed.

  • Signature of the Contract more than 10 weeks before arrival:
  • Deposit of 30% of the total amount at the moment of the Contract’s signing,
  • Outstanding balance no later than 30 days before arrival.
  • Signature of the Contract less than 10 weeks before arrival:
  • Deposit of 70% of the total amount at the moment of the Contract’s signing,
  • Outstanding balance no later than 10 days before arrival.

The Booking is final and the contract binding from the moment the deposit is paid.

MIJE will not send a reminder for payment of the outstanding balance. If payment is not made within the outlined timeframe, the Contract will be considered rescinded by the Client with application of cancellation fees as set out in article 5.

MIJE will provide the name and address of the hostel to the Client no later than a week before the date of arrival.

Article 2. Pricing

The applicable rate is that which is indicated on the quote, for the services mentioned therein. Rates are expressed in Euros, including taxes, taking into account VAT as indicated on the quote. Any change to the applicable VAT rate will automatically be applied to the prices indicated at the date of billing.

The cost of solidarity membership to the MIJE association is to be paid at the moment of the first Booking of the year and is valid for any other Booking over that civil year.

Article 3. Payment

3.1 Payment methods

Payment may be made by bank transfer, credit card (Visa – Mastercard only) including online payment, cheque made payable to MIJE or vacation vouchers (Chèques-Vacances).

3.2. Late payment penalties

Invoices are payable on receipt. Any delay in payment shall automatically entail :

  • the payment of late payment interest, calculated on the basis of three times the legal interest rate, which runs from the day following the due date for payment until the day of payment,
  •  payment of a flat-rate indemnity for collection costs of 40 euros excluding VAT. In the event that the collection costs incurred exceed this amount, MIJE may request additional compensation, subject to justification.

Article 4. Insurance

4.1. Assistance insurance

Assistance insurance is included for all trips and covers assistance & repatriation services, civil liability, loss or theft of luggage and additional epidemic assistance (hotel expenses).

4.2. Cancellation insurance

Upon request, a trip cancellation insurance can be taken out with ASSURINCO through the intermediary of MIJE. To be valid, it must be taken out for all the participants in a group, on the day the deposit is received along with the registration form.

Please note: the final list of participants must be provided 45 days before the beginning of the trip; without this list, the insurance coverage cannot be guaranteed.

Article 5. Booking cancellation / change by the client

The Client can cancel or modify their Booking by email, giving the Booking’s references. For any cancellation, or decrease in the number of participants, indemnities will be applicable as follows:

  • for requests made more than 31 days before the date of arrival: 25 % of the Booking price;
  • between 30 and 21 Booking before the date of arrival: 50 % of the Booking price;
  • between 20 and 8 days before the date of arrival: 75 % of the Booking price;
  • less than 8 days before the date of arrival: 100 % of the Booking price.

The solidarity membership to MIJE is in no case reimbursed.

Any service begun and interrupted is payable in full by the customer, and cannot be reimbursed for any reason whatsoever.

In the event of an increase in the number of participants, the duration of the stay, or the breakdown (girls/boys), a new request must be submitted to the MIJE association.
The request will not be considered accepted without the MIJE’s written agreement.
In the absence of MIJE’s agreement, the initial reservation (number of participants, dates and duration of stay, breakdown) will prevail.

In the event of a change in numbers, dates, length of stay or allocation resulting in the immobilization of unoccupied beds, charges for these “empty” beds will be applied in accordance with current rates.

Article 6. Booking cancellation / change by Mije

Should the deposit be refused or not be received in the established timeframe, the Booking will automatically by cancelled by MIJE.

For accommodation, failing availability of beds in the Hostels, MIJE reserves the right to provide, for all or part of the stay, Client accommodation in another establishment of equivalent standing, for services of the same nature. Any surcharge for the room and public transport expenses between the two establishments are borne by MIJE. The Client cannot claim any compensation.

Article 7. Conditions of accommodation and room rental in Mije hostels

7.1. Location of stay

MIJE does not guarantee that the entire duration of the stay will take place in the same room, or in the same Hostel. Similarly, MIJE does not guarantee that all members of a group will be accommodated in the same Hostel. In the case of a room change over the course of the stay, luggage must be dropped off before 12:00pm (noon) in the luggage room; access to the new room will be given from 3:00pm. The Client cannot claim any compensation due to a room or Hostel change over the course of their stay.

Bed assignments are made at MIJE’s discretion.

7.2. Hours

Accommodation:

Rooms are available from 3:00pm on the day of the Client’s arrival and check out is at 12:00pm (noon) at the latest on the day of departure. Failing this, an extra night will be billed.

Facility rentals:

Rooms can be rented for a day (from 8:00am until 6:00pm) or a half-day (fixed rate for 4 hours).

7.3. Minors

Minors under the age of 17 cannot stay in the Hostels without being accompanied by an adult.

A 17-year-old minor can stay in one of the Hostels without being accompanied by an adult provided that a signed parental authorisation and a copy of both parents’ ID are presented upon arrival.

Failing to meet these conditions, the Booking will be cancelled upon arrival. No reimbursement of the Booking will be made.

7.4. Accessibility

The number of rooms equipped for persons with reduced mobility is limited. If a Client wishes to reserve such a room, a request should be submitted to MIJE at the time of booking. Otherwise, MIJE cannot be held responsible for the unavailability of an appropriate room.

7.5 Documents to present for accommodation Bookings

Valid photo ID (national ID card or passport) must be shown upon arrival by each Beneficiary.

In application of article R. 611-42 of the French Code for Entry and Residence of Foreigners and the Right of Asylum, each foreign Beneficiary, including European Union citizens, must fill out and sign, upon arrival, a police form provided by MIJE.

Failing the above, entrance to and accommodation in the Hostel will be refused to the Beneficiary. No reimbursement of Bookings will be made.

7.6. Rules of procedure

The Client accepts, and undertakes to respect, the Hostels’ Rules of procedure which are displayed on site.

In case of disrespect of the Rules of procedure, the Client will have to check out of the Hostel, without the possibility of claiming compensation or reimbursement.

Animals are not accepted in the Hostels except for guide dogs for the blind only if Bookings in Private rooms have been made.

Article 8. Libability

Photographs posted online are only indicative and non-contractual.

The Client is liable for all damages incurred in the rented/occupied room whether caused by them, their guests or any other person under their responsibility. The Client undertakes to cover all replacement and restoration costs due to damage. The payment will be made at the Hostel before departure.

The Client ensures that the Beneficiaries respect these GTC and the Hostels’ Rules of procedure.

MIJE reserves the right to charge the Client restoration and replacement costs after leaving the Hostel. An email will be sent to the Client indicating that they will be billed the amount equivalent to the restoration and replacement costs for which a quote will be attached.

MIJE cannot be held liable, for personal affairs and/or purchases that are stolen, lost or damaged, beyond the limits set out by article 1953 of the French Civil Code.

Neither Party is liable for non-fulfilment of its obligations in the event of force majeure, as defined by the French Civil Code and interpreted by French courts. Parties agree that force majeure suspends the performance of obligations and that each Party bears their respective costs related thereto.

Article 9. Data protection

MIJE collects and processes personal information to record, amend and confirm Bookings, and to provide the services and arrange stays in the Hostels. The processing of personal data is necessary for the performance of these GTC. MIJE keeps personal Client data for 6 years, in accordance with article L. 102 B of the French tax procedure book.

MIJE undertakes not to sell or transfer Client data to any third parties at any time.

According to the Data Protection Law and GDPR, Clients have the right to:

  • request a copy of the information that MIJE holds concerning them,
  • ask MIJE to correct the data that MIJE holds concerning them which is inaccurate or incomplete,
  • ask for the data MIJE holds concerning them to be, in certain circumstances, erased,
  • ask that MIJE restrict the processing of their personal data where certain conditions apply,
  • object to certain types of processing,
  • have the data MIJE holds concerning them transferred to another organisation,

by contacting MIJE at the following address : MIJE – 13 boulevard Beaumarchais – 75004 Paris.

Clients also have the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (3 Place de Fontenoy, 75007 Paris; https://www.cnil.fr/).

Clients authorise MIJE to use their email address in order to send MIJE’s newsletters, latest information and promotional offers, and to gather customer feedback with a view to improve the services.

Article 10. Complaints

All complaints or disputes relating to the services provided by MIJE should be sent within 8 days of the date of departure of the Client, in writing, to the following email address:   Service-Client@mije.com.

Article 11. Applicable law – jurisdiction

These GTC are governed by and construed in accordance with French law. Any dispute related to these GTC will be settled by the competent courts of France

Article 12. Completeness

These GTC constitute the complete agreement between MIJE and the Client. The Client’s own terms and conditions of sale will therefore not Apply.

Article 13. Language

Only the French version is binding, regardless of the place of use.

Translations are made for information purposes only, the French version being the legally valid and binding version. In case of doubt, the French version takes precedence and has legal value.
